What is an ex parte hearing?

An ex parte hearing seeks immediate relief from the Court. Generally, very little notice of the ex parte hearing is given to the other side. Ex Parte hearings are often won or lost in the initial pleadings and often times the parties do not get to speak to the judge directly. Therefore, it is imperative, if you have been noticed for an ex parte hearing or if you need to call for an ex parte hearing that you meet with an attorney immediately.

The purpose of an ex parte hearing is to obtain emergency orders from the Court. In the family law context, these orders could include emergency modification of child custody and visitation orders or domestic violence restraining orders.

Why might emergency orders be necessary?

There are a myriad of reasons why an emergency order from the Court may be necessary.  Reasons may include:
